What is a Federal Bail Bond?
Federal Bail Bonds are Bail Bonds posted for criminal cases in a U.S. District Court House. This is a Bond for an individual who is in custody at a Federal Correctional Facility. When this bond is posted the accused is released from Federal Custody until his court hearing.
How long can an individual stay out jail after posting a Federal Bond?
The accused will remain out of jail until his case is adjudicated. The only exception to this is if the court violates his or her bond because of another arrest or infraction.
What types of Federal Bonds are there?
- A Property Bond posted directly with the court house. This is where a friend or family member of the accused brings proof of land or homestead ownership and presents them as collateral directly to the Judge.
- A Court Percentage Bond posted directly with the court house. This is a court bond where the judge asks you to pledge U.S. currency in form of a cashiers check or certified check directly to the court clerk.
- A Corporate Surety Bond is a bond posted by a bondsman to secure a release of a Federal inmate accused of a crime. In this case the fee paid to a Bail Company is usually 15%. In the case of a CSB, collateral property is usually required.
Who decides what type of bond is set?
The Bond type is decided by a Federal Court Judge.
What happens to the pledged Collateral property if the person is convicted?
As long as the accused makes all their court appearances the property is always released, even if the defendant is found guilty.
